Immigrant Justice Project

The Immigrant Justice Project at SRLP works with low-income people and people of color who are transgender, gender nonconforming, and/or intersex (TGNCI) and either seeking legally recognized immigration status or are adjusting to a different immigration status. Immigrant justice has been identified as a key priority area in our work over the years because TGNCI immigrants often face legal obstacles when taking different paths to obtaining status, are especially vulnerable to the dual policing of the criminal justice and immigration enforcement systems, and are often not eligible for legal services elsewhere when their cases are “too messy” due to the criminalization, violence, and systemic discrimination that TGNCI people experience. The Immigrant Justice Project aims to work holistically with its clients, assisting immigrants with advocacy in the areas of public benefits, healthcare, Social Security, and other needs and resources. The Project works in coalition on policy strategies impacting TGNCI immigrants, including countering xenophobic laws that criminalize TGNCI immigrants and fighting for increased public benefits eligibility for immigrants.

Outcomes of the work include:

  • Representation of TGNCI immigrants in affirmative applications for immigration status
  • Adjustment of immigration status of TGNCI immigrants in their paths towards U.S. citizenship, minimizing their vulnerability as under-documented immigrants
  • TGNCI immigrants with legal status obtaining gender-affirming immigration documents, including Employment Authorization Documents (EADs), green cards, and naturalization certificates
  • Legal support provided for other immigration needs as presented by the individuals who come in looking for TGNCI-friendly immigration services
  • Holistic support of TGNCI immigrants in public benefits, healthcare, Social Security, including via coordination with other service providers working with the same individual
  • Increased capacity for leadership and SRLP membership by TGNCI immigrants
  • Development in competency and intersectional analysis of other advocates and practitioners working with TGNCI immigrants
  • Partnerships with allied organizations to fight against policies denying life-saving public benefits to TGNCI immigrants

El Proyecto de Justicia Inmigrante

El Proyecto de Justicia Inmigrante en SRLP trabaja con personas de bajos ingresos y personas de color que son transgéneros, género no conformistas, y/o intersexo (TGNCI) y buscan un estatus de inmigración legalmente reconocido o se están ajustando a un estatus de inmigración diferente. La justicia de inmigrantes ha sido identificada como un área de prioridad en nuestro trabajo a través de los años porque los inmigrantes TGNCI enfrentan obstáculos legales cuando toman caminos diferentes para obtener estatus, son especialmente vulnerables a los sistemas duales de policía de justicia penal e inmigración, y frecuentemente no son elegibles para servicios legales en otros lugares cuando sus casos son “demasiado desordenados” debido a la criminalización, la violencia y la discriminación sistémica que las personas TGNCI enfrentan. El Proyecto de Justicia Inmigrante tiene como objetivo trabajar de manera holística con sus clientes, ayudando a los inmigrantes con el apoyo en las áreas de beneficios públicos, acceso a la atención médica, Seguridad Social y otras necesidades y recursos. El Proyecto trabaja en coalición en estrategias políticas que afectan a los inmigrantes TGNCI, incluyendo contrarrestando las leyes xenófobas que criminalizan a los inmigrantes TGNCI y luchando para aumentar la elegibilidad de los beneficios públicos para los inmigrantes.

Los resultados del trabajo incluyen:

  • Representación de inmigrantes TGNCI en solicitudes afirmativas para estatus de inmigración
  • Ajuste del estatus de inmigración de las personas TGNCI en su camino hacia la ciudadanía de los Estados Unidos, minimizando su vulnerabilidad como inmigrantes insuficientemente documentados
  • Los inmigrantes TGNCI con estatus legal que obtienen documentos de inmigración que afirmen su género, incluyendo Documentos de Autorización de Empleo (EAD), tarjetas de residencia/tarjetas verdes y certificados de naturalización
  • Apoyo legal para otras necesidades de inmigración presentado por las personas que vienen en busca de servicios de inmigración competentes con la comunidad TGNCI
  • Apoyo holístico de inmigrantes TGNCI con los beneficios públicos, acceso a la atención médica, Seguridad Social, incluso mediante la coordinación con otros proveedores de servicios que trabajan con el mismo individuo
  • Mayor capacidad de liderazgo y membresía de SRLP por parte de los inmigrantes TGNCI
  • Desarrollo en competencias y análisis interseccional de otros defensores y profesionales que trabajan con inmigrantes TGNCI
  • Colaboraciónes con organizaciones aliadas para luchar contra las políticas que niegan los beneficios públicos que salvan vidas a los inmigrantes TGNCI
